Article 1. Publisher of the eMediaPlace service

Article 2. General presentation of the eMediaPlace service

The eMediaPlace service is a platform for purchasing software and game activation codes for PC / Mac accessible at https://www.softs.emediaplace.com . The eMediaPlace service is open to any natural person. Minors can access the eMediaPlace service under the responsibility of their legal representatives and must obtain their authorization to place orders there. The publisher of the eMediaPlace service reserves the right to carry out any useful checks and to request the written authorization of a legal representative of the minor. Failing to justify such authorization, the minor’s orders cannot be fulfilled.

Article 3. Definitions

In these general conditions of sale and use, each of the terms, expressions or acronyms used below with a capital letter has the meaning of the following definition:

CGVU: indicates the present general conditions of sale and use of the eMediaPlace softs service.

User Account: designates the account created by the user with the eMediaPlace softs service.

Payment account: access account to one of the payment methods accepted by the site https://www.softs.emediaplace.com

To make purchases on the https://www.softs.emediaplace.com site , only an eMediaPlace softs account is required.

Edition: designates the digital version of software or games whose activation codes are offered for sale to the user on the eMediaPlace softs service.

Web browser: web browsers compatible with the eMediaPlace service such as Internet Explorer in its version greater than 9, Chrome in its version greater than 3, Safari in its version greater than 3, Firefox in its version greater than 3. All the web browsers mentioned must be provided with the Flash Plugin in its version greater than 10.

EMediaPlace service: designates the service operated by eMediaPlace accessible from the site www.softs.emediaplace.com, offering the user access to the software and games catalog, to purchase activation codes on the site www.softs .emediaplace.com and download an edition to its terminal in order to use it.

Terminal: refers to terminals compatible with the eMediaPlace softs service, namely:

Personal computers under Windows or MacOS whose versions of systems and hardware configurations will be compatible with the indications provided for each software and games chosen

Titles: names of software and games in the softs eMediaPlace catalog.

User: means a natural person using the eMediaPlace softs service who has subscribed to the service an individual offer to buy an activation code for software or games.

Article 4. Purpose of the general conditions of sale and use of the eMediaPlace service

The purpose of this document is to determine the general conditions of sale and use (CGUV) of the eMediaPlace softs service. It defines the rights and obligations of eMediaPlace and the users of the service in the context of the use of the eMediaPlace service.

The CGVU are offered in French and English only.

Article 5. Acceptance and modification of the general conditions of sale and use of the eMediaPlace service

eMediaPlace reserves the right to modify the eMediaPlace softs service as well as the content of the T & Cs at any time.

Article 6. Registration and access to the eMediaPlace soft service

The user acknowledges that eMediaPlace reserves the right to suspend or withdraw the possibility of accessing the service, as long as the user does not comply with these registration terms, and particularly if he provides false or whimsical, inaccurate, incomplete or not updated.

In no case can the responsibility of eMediaPlace be engaged in the event of an error, omission or imprecision in the information communicated by the user under its responsibility.

6.2 Access to the eMediaPlace soft service

It is however specified that the communication and downloading costs invoiced by the telephone operator or the Internet service provider of the user remain the responsibility of the user.

The user does not have the authorization to represent, reproduce, modify, distribute or use commercially the different elements of the eMediaPlace softs service outside the conditions provided for in the CGVU.

The CGVU do not entail the transfer of any intellectual property rights to the user, including when purchasing an act of an edition.

All reproduction rights are reserved, including for texts, downloadable documents, iconographic and photographic representations. As such, in the absence of express authorization from eMediaPlace, it is strictly prohibited to use the content of the eMediaPlace softs service and in particular to reproduce, represent, modify or adapt it in whole or in part.

Article 10. Customer service and technical support

For any question related to the installation or use of the software and games purchased, only the support services and customers of the Software or game publishers can be contacted. eMediaPlace can in no way replace these services of the Publishers.

Article 13. Liability

eMediaPlace makes every effort to offer users of the softs eMediaPlace service the latest tools.

eMediaPlace can in no way be held responsible for the speeds of access to the eMediaPlace softs service, of access to the data of the eMediaPlace softs service, of downloading or even of suspension or temporary impossibility of access.

The user is solely responsible for its technical equipment and its compatibility with the eMediaPlace soft service, as well as the software and games for which it has purchased the activation codes. It must prevent possible intrusions or viruses by the usual means (Firewall, anti-virus, etc.) which are not the responsibility of eMediaPlace.

EMediaPlace cannot be held liable in the event that the content of the editions, as well as any hypertext links pointing to other sites, contravene the rights of third parties and more generally the legal or regulatory provisions in force.

Unless proven otherwise, the data recorded by the eMediaPlace softs service constitutes proof of all transactions between the eMediaPlace service and its user.

Article 14. Modification and termination of the eMediaPlace service

eMediaPlace reserves the right to modify the conditions of use of the eMediaPlace softs service and / or the offers at any time as well as the value of software and games depending on the currency.

The possible termination of the eMediaPlace service will be announced to users by email with thirty days (30 days) notice.
